WEST PALM BEACH, FL – Murray Guari Trial Attorneys has filed suit against The Original Pancake House in Aventura, Florida in Circuit Court in Miami-Dade County on behalf of its client, well-known actress JoMarie Payton-Downs. Mrs. Downs was visiting the restaurant with business colleagues the morning of August 17, 2013, when she slipped and fell on a dirty floor, that should have been cleaned in the restaurant.
Mrs. Payton is a well-known, celebrated television actress and singer who is most recognized for her role as Harriette Winslow on Perfect Strangers and Family Matters and as the voice of “Sugar Mama” in The Proud Family Movie. After leaving Family Matters, Mrs. Payton continued to work as an actress, singer, and acting coach.
After she fell at The Original Pancake House, her life drastically changed. She has been forced to submit to multiple medical procedures and surgery, after exhausting all conservative measures.
Though Mrs. Payton has, somewhat, returned to work, her limitations are many. She has had to turn down multiple acting and coaching opportunities as her ability to travel has been substantially limited. She is forced to take medication daily to alleviate the discomfort caused by the negligence and carelessness of The Original Pancake House who will not take full responsibility for its employees’ negligence.
Almost two years have gone by since Mrs. Payton fell. Throughout the past 18 months, her attorneys have been in contact with the insurer for the restaurant. All attempts to resolve Mrs. Payton’s claim have proven to be futile since the insurance company for The Original Pancake House refuses to fairly and justly compensate Mrs. Payton for her damages.
